Service Agreement
This Service Agreement ("Agreement") sets out the terms under which BlueCollar AI provides its AI receptionist service to clients. By signing up and using the service, you ("the Client") agree to these terms.
1. Definitions
- "BlueCollar AI" means the company operating the service at bluecollar.ie.
- "Client" means the business or individual who has engaged BlueCollar AI to provide the service.
- "Service" means the AI virtual receptionist service described in Section 2.
- "Setup Fee" means the one-time fee payable at the start of the engagement.
- "Monthly Fee" means the recurring subscription charge for use of the service.
- "Caller" means any third party who contacts the Client's business via the AI receptionist.
2. Services provided
BlueCollar AI provides an AI-powered virtual receptionist that handles inbound phone calls on behalf of the Client. The service may include, depending on the plan selected:
- Answering inbound calls using a configured AI voice
- Qualifying callers and capturing lead information
- Call forwarding to one or more designated numbers
- Time-based and after-hours call routing rules
- Automated follow-up messages via WhatsApp or other agreed channels
- Data logging and lead capture delivered to the Client
- Multilingual call handling where configured
- Integration with third-party tools as agreed during onboarding
The specific features included in the Client's service are determined by the plan agreed at sign-up. BlueCollar AI reserves the right to adjust feature availability with reasonable notice.
3. Onboarding & setup
Following sign-up and payment of the Setup Fee, BlueCollar AI will work with the Client to configure the service. The onboarding process typically includes:
- An initial call to understand the Client's business, call types, and routing preferences
- Configuration of the AI voice, scripts, and business-specific responses
- Setting up forwarding rules, after-hours logic, and follow-up messages
- A test call to demonstrate the service before going live
The Client is responsible for providing accurate and complete information during onboarding. The quality of the service depends on the accuracy of the information provided. BlueCollar AI will make reasonable efforts to complete setup within an agreed timeframe, but cannot guarantee specific go-live dates if the Client delays in providing required information.
4. Client responsibilities
The Client agrees to:
- Provide accurate information about their business during onboarding and notify BlueCollar AI of any significant changes
- Ensure their use of the service complies with all applicable Irish and EU laws
- Inform their customers that calls may be handled by an AI receptionist, where required by law or best practice
- Not use the service for any unlawful, fraudulent, or harmful purpose
- Pay all fees when due
- Keep their account and login credentials secure
- Notify BlueCollar AI promptly if they become aware of any misuse or security issue
The Client is the data controller for any personal data captured about their callers. The Client is responsible for their own GDPR and data protection compliance in relation to that data.
5. Pricing
Monthly fees for the service range from €175 to €1,000 per month, depending on call volume and the features required. The exact fee is agreed with the Client before sign-up.
BlueCollar AI reserves the right to adjust pricing with a minimum of 30 days' written notice to the Client. If the Client does not accept the new pricing, they may terminate the service before the new pricing takes effect without penalty, in accordance with Section 15.
All prices are quoted exclusive of VAT unless stated otherwise. VAT will be applied in accordance with applicable Irish tax regulations.
6. Setup fee
A one-time setup fee applies to all new engagements. This fee covers the cost of onboarding, configuration, testing, and initial deployment of the service for the Client's specific business.
The setup fee is non-refundable in all circumstances. This applies regardless of whether the Client chooses to proceed with the ongoing service, exercises the one-month guarantee (see Section 8), or terminates the agreement at any point after sign-up. The setup fee compensates BlueCollar AI for the time and resources invested in configuring the service.
The setup fee must be paid in full before onboarding begins. BlueCollar AI will not commence configuration until the setup fee has been received.
7. Billing & payment
Monthly fees are billed in advance on a rolling monthly basis. The first monthly fee is due at the point of sign-up (in addition to the setup fee), unless the Client is exercising the one-month guarantee period, in which case the first monthly billing commences after the guarantee period.
- Payment is due within 7 days of invoice
- Accepted payment methods will be confirmed at sign-up
- Late payment may result in suspension of the service after reasonable notice
- Persistent non-payment may result in termination in accordance with Section 15
BlueCollar AI will issue invoices by email to the billing address provided at sign-up. It is the Client's responsibility to keep their billing contact details up to date.
8. One-month guarantee
BlueCollar AI offers a one-month satisfaction guarantee to all new clients. The terms of this guarantee are as follows:
If the Client is not satisfied with the service during the first calendar month of use, the first month's usage fee will be waived in full. The Client will not be charged for that month's subscription. This guarantee exists because we are confident in the quality of the service and want new clients to be able to experience it without financial risk.
Conditions of the guarantee
- The guarantee applies to the first month of active service use only
- To exercise the guarantee, the Client must notify BlueCollar AI in writing (by email to info@bluecollar.ie) before the end of the first month
- The Client must provide a brief explanation of why they are not satisfied, to allow BlueCollar AI to improve
- The guarantee covers the monthly usage fee only — the setup fee remains non-refundable in all cases
- The guarantee may not be exercised if the Client has materially breached this Agreement
- The guarantee applies once per client — it cannot be applied to a re-engagement following a previous cancellation
On exercise of the guarantee, BlueCollar AI will issue a credit or waiver for the first month's fee within 7 business days of receiving the notification.
9. Call handling
BlueCollar AI does not record calls. No audio recording is made or retained of any call handled by the AI receptionist. This is a firm operating principle and not subject to change without explicit notice.
BlueCollar AI does not listen to calls. No employee, contractor, or representative of BlueCollar AI accesses, monitors, or reviews any live or historical call. The AI operates fully autonomously.
BlueCollar AI will use reasonable skill and care in providing the service, but cannot guarantee:
- That every call will be handled without error
- That the AI will correctly handle all edge cases or unusual caller requests
- That call forwarding will succeed if the Client's designated numbers are unreachable
- Uninterrupted service availability at all times
In the event of service disruption, BlueCollar AI will use reasonable efforts to restore the service as quickly as possible and will notify the Client if an outage is expected to be prolonged.
10. Data ownership
All data captured by the AI receptionist on the Client's behalf — including caller names, phone numbers, call summaries, lead logs, and integration outputs — belongs entirely to the Client.
- BlueCollar AI does not claim any ownership of or rights over Client data
- BlueCollar AI will not use, share, sell, or analyse Client data for any purpose other than delivering the service
- On termination of the service, Client data will be returned in an agreed format or securely deleted within 30 days, at the Client's instruction
BlueCollar AI acts as a data processor on the Client's behalf. The Client is the data controller and is responsible for their own compliance with data protection law in relation to their callers' personal data.
11. Integrations
Where the Client requests integration with third-party tools (such as WhatsApp Business, n8n, CRM systems, or scheduling platforms), the following applies:
- BlueCollar AI will configure integrations as agreed during onboarding or as subsequently requested in writing
- Third-party integrations are subject to the availability and terms of service of those platforms — BlueCollar AI is not responsible for outages, changes, or limitations imposed by third parties
- The Client is responsible for ensuring they have the necessary accounts, permissions, and consents to use any integrated platform
- BlueCollar AI will not be liable for data loss or errors arising from third-party platform behaviour
Significant changes to integrations (such as migrating to a different platform) may incur additional configuration fees, which will be agreed with the Client in advance.
12. Support & changes
BlueCollar AI provides ongoing support for the service by email and phone during normal business hours (Monday–Friday, 9am–5pm Irish time, excluding public holidays).
The Client may request changes to their service configuration (such as updating scripts, changing forwarding numbers, or adjusting after-hours rules) by contacting BlueCollar AI at info@bluecollar.ie. BlueCollar AI will make reasonable efforts to implement changes promptly.
- Minor changes (e.g. updating a phone number) are included in the monthly fee
- Significant reconfigurations or expansions of the service may incur additional fees, which will be quoted in advance
BlueCollar AI may update, improve, or modify the service from time to time. Where changes materially affect the Client's use of the service, BlueCollar AI will provide reasonable advance notice.
13. Acceptable use
The Client must not use the service for any purpose that is unlawful, harmful, or contrary to this Agreement. Prohibited uses include, but are not limited to:
- Using the service to deceive callers in a fraudulent or misleading manner
- Using the AI receptionist in connection with any illegal activity
- Attempting to reverse-engineer, copy, or reproduce the underlying technology
- Using the service to harass, intimidate, or collect data on individuals without lawful basis
- Reselling or sub-licensing the service to third parties without written consent from BlueCollar AI
BlueCollar AI reserves the right to suspend or terminate the service immediately and without refund if it determines that the Client is in breach of this section.
14. Limitation of liability
To the fullest extent permitted by Irish law, BlueCollar AI's total liability to the Client — whether in contract, tort (including negligence), or otherwise — is limited to the total monthly fees paid by the Client in the three months preceding the event giving rise to the claim.
BlueCollar AI is not liable for:
- Loss of revenue, profit, business, or opportunity arising from a missed or mishandled call
- Indirect, consequential, or special losses of any kind
- Losses arising from third-party platform outages or failures
- Losses arising from inaccurate information provided by the Client during onboarding
- Caller dissatisfaction with the AI receptionist experience
Nothing in this Agreement limits liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be lawfully excluded under Irish law.
15. Termination
By the Client
The Client may terminate this Agreement at any time by providing 30 days' written notice to info@bluecollar.ie. The Client will be responsible for any fees due during the notice period. No partial-month refunds will be issued for the final month.
If the Client is exercising the one-month guarantee (Section 8), termination during the first month does not require 30 days' notice — the Client simply notifies BlueCollar AI before the end of the first month.
By BlueCollar AI
BlueCollar AI may terminate this Agreement with 30 days' written notice to the Client without cause. In this case, BlueCollar AI will refund any prepaid monthly fees for the period beyond the termination date.
BlueCollar AI may terminate immediately and without refund if the Client:
- Materially breaches this Agreement and fails to remedy the breach within 7 days of written notice
- Fails to pay fees when due and does not remedy the non-payment within 14 days of notice
- Engages in conduct that violates the Acceptable Use section (Section 13)
Effect of termination
On termination, the Client's access to the service will cease. BlueCollar AI will return or delete Client data as instructed (see Section 10). The setup fee is non-refundable in all termination scenarios.
16. Governing law
This Agreement is governed by the laws of Ireland. Any dispute arising from or in connection with this Agreement shall be subject to the exclusive jurisdiction of the Irish courts.
Nothing in this Agreement affects any statutory rights the Client may have under Irish consumer or business law.
